New York allows married couples to live apart while remaining legally married through a voluntary written contract called a separation agreement. Unlike an annulment, which is a court determination that a marriage was invalid from the start due to fraud, duress, or illegality, a separation agreement leaves the marriage intact. It establishes the rights and obligations of each spouse while they live separate lives.

The agreement becomes legally binding once both spouses sign and it is notarized. Court approval isn’t required for it to be valid. Either spouse may also file the agreement with the County Clerk in the county where they live, though that step is optional.

Common Reasons to Choose Separation Over Immediate Divorce

Not every couple in conflict is ready for divorce. Some choose separation because of religious or moral objections to ending the marriage outright. Others stay married on paper to preserve access to a spouse’s health insurance coverage. Some couples also want time: a structured period to decide whether to reconcile or move forward with divorce. Since 2010, New York has also allowed no-fault divorce based on a sworn statement that the marriage has been irretrievably broken for at least six months.
