New York law generally permits spouses to make written agreements concerning defined financial and property rights. The terms should identify the issues the spouses intend to resolve rather than rely on broad descriptions of marital rights.

The agreement may address:

  • Property classification: The agreement can identify marital property and separate property, including real estate, inherited assets, and business interests.
  • Debt responsibility: It can state how specified existing or future obligations are allocated between the spouses.
  • Spousal maintenance: The spouses can establish maintenance terms, subject to applicable New York law.
  • Estate-related rights: The agreement can include certain testamentary provisions or waivers coordinated with estate planning documents.
  • Child-related terms: Provisions involving children remain subject to statutory limits and court review.

A prenuptial agreement is signed before marriage, while a postnuptial agreement is signed during the marriage. Under New York Domestic Relations Law § 236(B)(3), an agreement made during marriage must be in writing, signed by both spouses, and acknowledged or proven in the manner required for a deed to be recorded. An acknowledgment formally verifies the signatures, typically before a notary or another authorized official.

Because spouses have a relationship of trust, courts can examine the circumstances surrounding the agreement. Concerns may include fraud, duress, overreaching, inadequate financial disclosure, unclear language, or unconscionable terms that are fundamentally unfair. Satisfying the signing formalities alone doesn’t mean that every provision would later be enforced.
