- Second-Parent Adoption: Allows an unmarried or same-sex partner to become a legal parent alongside the child’s existing legal or biological parent, without terminating that parent’s rights.
- Relative Adoption: May involve grandparents, aunts, uncles, or siblings, and can arise from a parent’s death or termination of parental rights.
- International Adoption: Subject to U.S. federal requirements, the laws of the child’s country of origin, and New York finalization requirements.

Home Study & Background Requirements
New York requires a home study to assess your home environment, finances, health, and the background of every adult in the household. Depending on your adoption type, this may be conducted by an authorized adoption agency, a licensed social worker, or another court-approved provider. Background checks cover criminal history, federal sex offender databases, and the State Central Register for Abuse and Neglect. I prepare clients for this process and review documentation before submission to reduce the likelihood of delays.
Petitions, Consent & Court Filings
Adoption petitions for Syracuse residents are filed with Onondaga County Family Court, which has a dedicated adoptions unit. Depending on your adoption type, the petition may need to be accompanied by consent documents, home study reports, financial disclosures, and proof of background clearances. Under New York law, children 14 or older must also provide their own consent. I handle all documentation, coordinate filings, and appear with you at each required court appearance.
Termination of Parental Rights & the Order of Adoption
Some adoptions require a separate proceeding to terminate a biological parent’s parental rights before the adoption can move forward. Once a judge signs the Order of Adoption, a new birth certificate may be issued in the child’s adoptive name, and original court records are generally sealed. The process may also include a legal name change for the child at finalization.
